TERMS OF SALE

These Terms of Sale set out the general conditions governing orders, sales, payments, production, delivery, cancellation, withdrawal, returns and exchanges for products and services offered by Armada Heritage.

Customers placing an order are responsible for reviewing the product information, prices and applicable sales conditions provided before the order is confirmed.

1. Placing an Order

Orders for Armada Heritage products may be submitted through the ordering channels available on the website and via WhatsApp.

Customers may select the available size, color, quantity and other product options before submitting an order request.

For personalized products, custom production and bulk orders, design, product, quantity, material, application and other project details may be determined separately.

The process for finalizing an order depends on the nature of the order and the applicable sales method.

2. Product Information

The main characteristics, available options and relevant information concerning products are provided, where applicable, on the product page or during the ordering process.

Minor variations in color or appearance may occur due to screen settings, lighting conditions, fabric and material characteristics, production tolerances or personalization processes.

Such variations do not affect the customer's statutory rights where a product is defective or does not conform to the agreed order.

3. Pricing

The applicable sales price is the price communicated to the customer when the order is placed or the price stated in an approved quotation.

For personalized products, custom production and bulk orders, pricing may vary according to product type, quantity, materials, design, printing, embroidery, personalization and other production details.

Any applications requiring additional charges are communicated before the order or project is finalized.

4. Quotation-Based Products

Products and services marked “Request a Quote” may not have a fixed sales price displayed on the website.

Pricing is determined after evaluating the requested product, quantity, design, materials and production specifications.

The scope and validity conditions of each quotation are communicated separately.

5. Payment

Available payment methods are communicated during the ordering process.

Depending on the nature of the order, production or processing may begin after payment has been completed or the agreed payment conditions have been fulfilled.

No additional payment or service charge will be added without the customer's explicit approval.

6. Stock and Availability

Product availability may change over time.

A product being out of stock does not, by itself, necessarily constitute legal impossibility of performance.

If circumstances arise that affect fulfilment of an order, the customer will be informed and the necessary procedures will be carried out in accordance with applicable legislation.

7. Pre-Orders

Products marked “Pre-Order” may not yet be in stock or may still be in production.

Estimated production, preparation or shipping information may be provided for the relevant product.

Estimated dates for pre-order products may change depending on the production process. Mandatory consumer rights under applicable legislation remain unaffected.

8. Personalized and Custom-Made Products

Products featuring names, custom measurements, personalized designs, logos, images, colors, printing, embroidery or other customer-specific requirements may be considered personalized or custom-made products.

Products prepared according to the consumer's specific requests or personal requirements may fall within statutory exceptions to the right of withdrawal.

Statutory consumer rights remain unaffected where a product is defective, faulty or does not conform to the agreed order specifications.

9. Design Approval

For custom design and production projects, design and application details may be submitted to the customer for approval before production begins.

Production may begin based on the design and specifications approved by the customer.

Changes requested after approval are subject to production feasibility and may result in additional costs or lead time.

10. Customer-Provided Designs

Customers are responsible for ensuring that they possess the necessary rights and permissions to use any logos, images, text, designs or other content they provide.

Production requests involving content that infringes intellectual property, personality or other rights of third parties may be refused.

11. Preparation and Shipping

In-stock ready products are normally prepared and dispatched within 1-3 business days following the order.

Preparation times for personalized, custom-made and pre-order products may vary depending on product specifications, personalization requirements and the production schedule.

Estimated preparation and shipping information is communicated in connection with the relevant product or order.

Mandatory statutory delivery periods and consumer rights remain unaffected.

12. Delivery

Orders are shipped according to the delivery information provided by the customer.

Customers are responsible for ensuring that the delivery information submitted with the order is accurate and complete.

Any mandatory consumer rights concerning loss or damage during delivery remain unaffected.

13. Right of Withdrawal

For products purchased through distance sales that are not subject to a statutory exception, consumers may exercise their right of withdrawal within 14 days from delivery without providing a reason and without incurring a contractual penalty.

Consumers may also exercise their statutory right of withdrawal before delivery where applicable.

The withdrawal notice must be submitted within the statutory period in writing or through another durable medium permitted by applicable legislation.

14. Exceptions to the Right of Withdrawal

Applicable legislation provides certain exceptions where the right of withdrawal cannot be exercised.

Products prepared according to the consumer's specific requests or personal requirements may fall within these exceptions.

Other statutory exceptions may apply depending on the nature of the relevant product.

Any exception to the right of withdrawal does not affect statutory consumer rights relating to defective or non-conforming goods.

15. Returns and Exchanges

Returns and exchanges are handled in accordance with applicable legislation, the relevant order conditions and the Armada Heritage Returns & Exchanges Policy.

Where the right of withdrawal is validly exercised, the product must be returned within the period prescribed by applicable legislation.

Exchange requests are evaluated according to the nature of the product and stock availability.

16. Refunds

Where the conditions for withdrawal or refund are met, refunds are processed within the periods and conditions prescribed by applicable legislation.

Where the statutory right of withdrawal is validly exercised, refunds are processed in accordance with applicable legislation without imposing additional costs on the consumer.

17. Damaged, Incorrect or Incomplete Products

If an order arrives damaged, incorrect, incomplete or different from the agreed specifications, customers are encouraged to contact Armada Heritage with their order information and, where possible, photographs showing the issue.

The request will be reviewed and an appropriate resolution process initiated.

All statutory rights relating to defective or non-conforming goods remain unaffected.

18. Force Majeure

Delays may occur due to natural disasters, war, epidemics, strikes, serious disruptions to transportation or communications infrastructure, decisions of public authorities or similar circumstances beyond the reasonable control of the parties.

Any mandatory rights available under applicable legislation remain unaffected.

19. Consumer Rights

Nothing in these Terms of Sale shall be interpreted as excluding or unlawfully restricting any mandatory rights granted to consumers under Turkish Consumer Protection Law No. 6502 and applicable legislation.

20. Amendments

Armada Heritage may update these Terms of Sale for future transactions, subject to applicable legislation.

The contractual and sales conditions applicable when an order was concluded will be taken into account for that order.
